1. Introduction
These Terms & Conditions (“Terms”) govern your access to and use of the website www.triumphofhopefoundation.org (the “Website”), all services, programs, donations, volunteer registrations, events, communications, and any other interactions with Triumph of Hope Foundation (hereinafter “we”, “us”, “our”, or the “Foundation”), a Section 8 non-profit company incorporated under the Companies Act, 2013 on December 5, 2025 (CIN: U88100MH2025NPL462063), having its registered office at C/o Aruna Dharmveer Vaidhya, Kalimatitha, Kalimati, Amgaon, Gondia – 441902, Maharashtra, India.

By accessing or using our Website, making a donation, registering as a volunteer, participating in any program/event, or otherwise engaging with us, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws. If you do not agree with any part of these Terms, you must not use our services or Website.

2. Nature of the Foundation
Triumph of Hope Foundation is a non-profit company limited by shares registered under Section 8 of the Companies Act, 2013.
All income, profits, and property of the Foundation shall be applied solely towards promotion of its objects as set out in the Memorandum of Association and shall not be paid or distributed by way of dividend, bonus or otherwise by way of profit to its members.
The Foundation is not yet registered under 12A/80G of the Income Tax Act, 1961 (application process may be initiated in future). Donations made at present may not qualify for tax deduction under Section 80G unless and until such registration is obtained.

3. Donations
All donations are voluntary and non-refundable.
Donations are accepted only for the furtherance of the charitable objects of the Foundation (education, health & hygiene, safe drinking water, women empowerment, environmental sustainability, skill development, welfare of vulnerable sections, etc.).
We do not guarantee any specific use of funds for any particular individual or sub-project unless explicitly agreed in writing by the Foundation.
Donations may be made through the Website (if payment gateway is integrated), bank transfer, or other modes communicated by us.
We do not store complete payment card details; such transactions are processed securely via third-party PCI-DSS compliant payment gateways.

4. Volunteer Participation
Volunteering with the Foundation is purely voluntary and unpaid.
Volunteers shall act in good faith, follow instructions/guidelines provided by the Foundation, and comply with all applicable laws.
The Foundation reserves the right to accept, reject, or terminate any volunteer association at its sole discretion without assigning any reason.
Volunteers are not employees/agents of the Foundation and shall not be entitled to any salary, benefits, or compensation except reimbursement of pre-approved out-of-pocket expenses (if any).
Volunteers agree that photographs, videos, or testimonials taken during activities may be used by the Foundation for promotional/non-commercial purposes.

5. Intellectual Property
All content on the Website (text, graphics, logos, images, videos, reports, etc.) is the property of Triumph of Hope Foundation or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, modify, distribute, display, or create derivative works from any content without our prior written permission except for personal, non-commercial use with proper attribution.

6. User Conduct
You agree not to:
– Use the Website/services for any unlawful purpose;
– Transmit any harmful, abusive, defamatory, obscene, or discriminatory content;
– Attempt to gain unauthorized access to any part of the Website;
– Interfere with the proper functioning of the Website;
– Impersonate any person or misrepresent your affiliation with the Foundation.

7. Limitation of Liability
To the maximum extent permitted by law, the Foundation, its directors, officers, employees, volunteers, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with:
– Use of or inability to use the Website/services;
– Any donation made;
– Participation in any program/event;
– Reliance on any information provided by the Foundation.
The Foundation does not warrant that the Website will be error-free, secure, or uninterrupted.

8. Indemnity
You agree to indemnify and hold harmless the Foundation, its directors, officers, employees, and agents from any claim, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of your violation of these Terms, misuse of the Website/services, or infringement of any third-party rights.

9. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Gondia, Maharashtra, India.

We reserve the right to modify, add, or remove any part of these Terms at any time. Changes will be posted on this page with an updated effective date.
